Full Exoneration

After originally being charged with Fleeing the Scene of an Accident, Driving While Intoxicated, Resisting Arrest, Obstructing Government Administration, Marijuana Possession, and Escaping a Police Precinct, in the case of the People of the State of New York vs. M.J., the jury delivered in swift fashion a not guilty verdict of all counts. Prior to the trial Managing Partner, Michael Alber, was able to successfully get the Court to dismiss leaving the scene of an accident and obstructing government administration.

After pre-trial hearings, Mr. Alber was able to successfully argue to have the search of the vehicle suppressed, leaving the Government no choice but to dismiss the marijuana charge.
At trial, Driving While Intoxicated, Resisting Arrest, and Escaping a Police precinct was submitted to the jury. On application by the Defense, the Court instructed the jury on justification for the Escape of the Police Precinct. On June 22, 2016, thanks to the hard work of all the members of Law Offices of Michael J. Alber, P.C, Mr. M.J., was fully exonerated of all charges.
